Your Rights in an on-the-job Injury

Question:
I have been injured on the job. Do I have any rights?

Answer:
Yes. If you are injured on the job, and your employer has workers' compensation insurance, you are entitled to medical care and disability benefits regardless of who was at fault.

The law requires, however, that you give your employer notice of your injury within 30 days of your injury and that you file a written Notice of Injury with the Texas Workers' Compensation Commission within one year of your injury.

You must comply with these requirements even if you are already receiving benefits. Failure to comply may result in the loss of all of your rights.

If someone other than your employer was at fault in your accident, you may have other rights.
