Texas Good Faith Donor Act

If I donate apparently wholesome food to a charity, can I be liable if my food causes food poisoning?

Answer:
No. The Texas Good Faith Donor Act generally protects you from liability in such circumstances. The Act also protects nonprofit organizations that distribute apparently wholesome food to the needy at no charge. The Act provides no protection, however, from food poisoning that results from gross negligence, recklessness, or intentional misconduct. You should never donate canned goods that are leaking, swollen, dented on a seam, or no longer airtight.
