Question:
I give people permission to use my undeveloped land for recreational purposes for free. Will I be liable for an injury or death if I fail to exercise reasonable care to protect these guests on my property?
Answer:
No. A statute passed by the Texas legislature abolished any duty of owners of land to use ordinary care to protect such guests on their property. Moreover, you do not incur liability for anyone else's injury caused by your guests. You will only be liable for an injury caused by your willful or wanton acts or gross negligence.
