Do I Have Any Rights if I’ve Been Injured by the Government?

Most adults injured in Texas know that they must file their lawsuit within two years from the date of their accident to protect their rights. Fewer people know that if the government is at fault and you’re making a claim against the government, you must give the government written notification of your claim much sooner.

The Texas Tort Claims Act requires that you give the government agency at fault written notice of your claim within six months and it specifies the information that must be in that claim. If your claim is against a city or a municipality, its charter or ordinances probably have shorter deadlines and more specific information that’s required. The government tries to restrict your rights, but yes you do have rights even if the government is at fault.
