About UM/UIM Insurance Coverage In Texas

It is tragic when someone has a serious car accident and then discovers they don’t have the kind of insurance protection they need.

Even though Texas law requires all drivers to be covered by liability auto insurance, not everyone follows the law, and, even if they do, many drivers buy only the minimum requirement. If you are hit by someone who doesn’t carry insurance or who doesn’t carry enough to cover your damages, the liability insurance you have will not help you. And if liability insurance is all you have, you could be stuck owing medical bills and losing income even though you weren’t at fault for the accident.

However, there is a way you can get your medical bills and lost wages paid if you are hit by an uninsured or underinsured driver. If you carry uninsured/underinsured motorist (UM/UIM) coverage on your own auto policy, then you can turn to that for protection. UM/UIM insurance covers you and any household family member riding in any car as well as any non-family members riding in your insured auto.

Uninsured motorist coverage (UM) is a type of optional coverage that compensates you for damages suffered in an auto accident when the at-fault driver had no insurance. It will also pay for hit-and-run accidents, so long as there was contact between the vehicles and the accident was promptly reported. UM will pay for losses including personal injuries, lost wages and property damage.

Underinsured motorist coverage (UIM) is another type of optional coverage that makes up the difference when the at-fault motorist has some coverage, but not enough to pay for all of the damages you suffered.

UM/UIM can also compensate you for your damages when the at-fault driver’s insurance company denies coverage or when the at-fault driver’s insurer is insolvent. UM/UIM can provide benefits not only for accidents that happen while you were driving, but also for wrecks where you were a passenger in another person’s car, as well as for accidents when you were walking or riding a bike under certain circumstances.

Although Texas law does not require you to purchase UM/UIM coverage, your insurance company must get you to sign a written waiver in order to exclude the coverage from your policy. Many people carry UM/UIM coverage without realizing it, and some might think they have it even if they don’t. Those who choose not to buy UM/UIM coverage should rethink that decision. It is usually quite inexpensive — as little as $43 per year — and can provide much needed coverage if you are injured in an accident with an uninsured or underinsured motorist.

Recovering UM/UIM Benefits Can Be Complicated

If you have been injured in an auto accident and it becomes apparent that the at-fault driver does not have enough coverage to compensate you for your injuries, you should consult with a qualified UM/UIM attorney like those at Roberts & Roberts. Recovering benefits under your UM/UIM policy can be a complex procedure. Many times, insurance companies are reluctant to compensate you for the full value of your injuries, even though you have paid your premium for years.

You are required to bring a claim for UM/UIM benefits within a limited time period after the accident, and you must be careful about settling a claim with the at-fault driver’s insurance company, if any coverage was available.

Once you have filed a UM/UIM claim, you have the burden to show that you are entitled to recover damages, and you must also justify the amount you are demanding. Even though it is your own insurance company, the adjustor will view your UM/UIM claim just as skeptically as if it were a claim from another driver. As with any claim, the insurance company’s objective is to settle your claim for as little money as possible.
